As he walked out of an alley, Merchant Policeman Lee was struck in the abdomen. He was able to return fire before the suspect fled the scene.

A male suspect, who was wounded in his arm, was arrested in Swayzee two days later. He was charged with first-degree murder, which was later dismissed for lack of evidence.

Merchant Policeman Lee was survived by his wife and father.
